The Amended B-BBEE Codes introduces the concept of an ‘Empowering Supplier’. Only Empowering Suppliers can contribute towards a measured entity’s Preferential Procurement scorecard. In other words, if an entity does not qualify as an Empowering Supplier, they will be deemed to be Non-Compliant, notwithstanding their achieved B-BBEE Status Level, whether it is a level 1 or a level 8. B-BBEE Certificates are required to disclose a measured entity’s (post discounted) B-BBEE Status Level, which must indicate either a ‘yes’ or ‘no’ under the Empowering Supplier indicator.
An entity’s Empowering Supplier status is evaluated with reference to the following pre-requisites and criteria: A measured entity must:
- be B-BBEE Compliant, at least a Level 8 status;
- be a good citizen South African Entity; and
- comply with all regulatory requirements of the country.
